Terms of Service

These Terms of Service ("Terms") govern your use of the Vaya mobile application and https://flyvaya.com (the "Service"), provided by Fix AI, Inc., doing business as Vaya ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Nature of Our Service

Vaya aggregates and displays travel deals from third-party websites. We are not a travel agency, airline, or booking platform, and we have no partnership or affiliation with the airlines or websites whose deals we display. When you click a deal, you are directed to a third-party website to complete any transaction. We do not control and are not responsible for the accuracy, availability, or validity of any deal, or for any transactions, bookings, or disputes with third-party providers.

2. Account Registration

To access certain features, you may need to create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Not share your account credentials with others

You are responsible for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at team@flyvaya.com.

3. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Reverse-engineer, decompile, or scrape our software or content
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to our systems
  • Use automated systems (bots, scrapers) to access the Service

4. Intellectual Property

The Service and its original content, features, and functionality are owned by Fix AI, Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

5. Subscription Refund Guarantee

We guarantee that Vaya will pay for itself: if you subscribe to Vaya Pro and the savings from the first deal you book while subscribed do not cover the cost of your subscription for that term, we will provide a full refund.

Eligibility: To qualify for a refund, you must:

  • Have an active paid Vaya Pro subscription (monthly or annual)
  • Book a deal using a link provided by the Vaya app while your subscription is active (this applies to the first deal you book during any given subscription term)
  • The discount displayed on the Vaya app at the time of booking must be less than the cost of your subscription for that specific term

How Refunds Work:

  • Monthly subscriptions: If you subscribe to our monthly plan and the first deal you book while subscribed in a given month has a discount less than that month's subscription cost, you are eligible for a refund of that month's subscription only. For example, if you maintain a monthly subscription for six months and the first deal you book while subscribed occurs in month three, you can only receive a refund for month three's subscription - not for all six months.
  • Annual subscriptions: If you subscribe to our annual plan and the first deal you book while subscribed during that year has a discount less than the annual subscription cost, you are eligible for a refund of that year's subscription. For example, if you purchase an annual subscription and the first deal you book while subscribed (in month eight) has insufficient savings, you can receive a refund for the full annual subscription cost.
  • The "discount" is defined as the savings amount displayed on the Vaya app at the time you booked the deal.

Requesting a Refund: To request a refund, contact us at team@flyvaya.com with your booking confirmation and the deal information as displayed in the app. Refunds will be processed within 7-10 business days of verification.

Important Limitations:

  • This guarantee applies only to the first deal you book while subscribed during any given subscription term
  • You can request a refund immediately after booking - no need to wait for travel
  • You must have booked the deal using a link provided by the Vaya app at the discount displayed on the app
  • If you book a deal at a higher price than what was displayed on the Vaya app (e.g., due to price increases or availability changes after you viewed the deal), the refund guarantee does not apply, as deal prices are subject to change and availability
  • This guarantee does not apply during free trial periods (only paid subscriptions are eligible)
  • This guarantee does not affect your statutory rights
  • This guarantee is subject to verification of booking details and deal information

6. In-App Purchases and Subscriptions (Apple App Store)

Vaya Pro subscriptions purchased through the Apple App Store are processed by Apple and subject to Apple's terms and conditions.

Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

Managing Subscriptions: You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase.

Refunds: Refund requests for purchases made through the App Store must be directed to Apple.

7. Push Notifications

With your consent, we may send push notifications to your device about travel deals, updates, and other information. You can disable notifications at any time through your device settings.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy, completeness, or validity of any travel deals displayed. Deals may expire, sell out, or contain errors at the source.

9. Limitation of Liability

To the maximum extent permitted by law, Fix AI, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages related to third-party bookings, lost savings, or missed travel opportunities.

10. Indemnification

You agree to indemnify and hold harmless Fix AI, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at our sole discretion, without prior notice, for any reason, including if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Delaware.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide notice through the Service or via email at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
